1. These Terms of Use shall be governed by and construed in accordance with the laws of the state of Israel. The parties will submit all their disputes arising out of or in connection with these Terms of Use to the exclusive jurisdiction of the Courts of Tel-Aviv, Israel.

If any provision of these Terms of Use is determined to be invalid or unenforceable, the provision shall be deemed to be severable from the remainder of these Terms of Use and shall not cause the invalidity or unenforceability of the remainder of these Terms of Use. This is the entire agreement between you and the Company with regards to the subject matter herein and these Terms of Use shall not be modified except as provided herein. The Company may assign this Terms of Use agreement, in whole or in part, in its sole discretion. The waiver by the Company of a breach of any provision of these Terms of Use shall not operate or be construed as a waiver of any other or a subsequent breach of the same or a different kind.

   2. שימושך באתר מהווה הסכמה לתנאי תקנון זה ולשאר התנאים המופיעים ו/או שיופיעו באתר בעת שימושך בו. ככל שאינך מסכים לאיזה מתנאי התקנון ו/או התנאים הנוספים באתר, הנך מתבקש להימנע מלעשות כל שימוש באתר מכל מין וסוג שהוא.

   2. אף הוראה מהוראות תנאי השימוש לא תתפרש באופן ישיר או משתמע כאילו בוצעה העברה או הענקה של זכויות כלשהן הכלולות באתר. על ידי השימוש באתר, אתה מסכים שלא להפר את האמור בסעיף זה ולא לפגוע בזכויות החברה.

   1. מבלי להגביל את האמור לעיל או להלן, Pas Pour Toi Ltd., הלוגו של החברה וסימנים מסחריים אחרים הכלולים באתר, הינם סימנים מסחריים של החברה. אין לבצע העברה או הענקה של זכויות כלשהן תחת שמות, סימנים או לוגו כלשהם באופן ישיר או משתמע מכל הוראה בתנאי שימוש אלה או מכל הוראה אחרת הכלולה באתר, וכל הזכויות בשמות, בסימנים או בסמלי לוגו, כאמור, שמורות על ידי החברה.
   
   

   סוד מסחרי

   1. מבלי להגביל את האמור לעיל ולהלן, המוצרים, הטכנולוגיה והתהליכים המסחריים של החברה או איזו מהחברות מטעמה המפורסמים באתר עשויים להיות מכוסים בפטנט אחד או יותר ו/או כפופים לסוד מסחרי אחר ו/או כל זכות קניינית אחרת. אין לבצע העברה או הענקה של זכויות כלשהן על פי פטנטים כאלה נעשית או משתמעת מכל הוראה בתנאי שימוש אלה או מכל הוראה אחרת הכלולה באתר, והחברה ו/או השותפים שלה שומרים לעצמם את כל הזכויות האמורות.
   
   

   קניין רוחני; מדיניות הפרה

   1. החברה מחויבת להגן על זכויותיהם של בעלי זכויות היוצרים ומצייתת לכל החוקים והתקנות החלים בנוגע להגנת הקניין הרוחני. במידה ואיזה מזכויות הקנייניות של מי ממשתמשי האתר הופרה – ניתן לפנות לחברה באמצעות טופס יצירת הקשר המקוון שלנו, הזמין באתר וההפרה תטופל בהקדם.
   
   
   

   קישורים

   1. פרט למקרים בהם נחתם הסכם בכתב או הסכמה ספציפית בתוקף עם החברה הקובע אחרת, ניתן לספק קישורים לאתר אך ורק באופן הבא: (א) אין ליצור רושם מטעה, על ידי הקישור לאתר, בכל דרך שהיא, שהחברה קשורה לכל אדם או ישות שהיא, או שהחברה תומכת, נותנת חסות או קשורה למוצר או שירות כלשהו; (ב) המראה, המיקום והיבטים אחרים של כל קישור לאתר לא יהיו כאלה שיפגעו בשמה הטוב של החברה ושל סימני המסחר שלה; (ג) כל הקישורים לאתר חייבים "להפנות" לכתובת האתר www.dodobaror.com,  ולא לעמודים אחרים באתר; (ד) אין להציג כל קישור שהוא לאתר, בעת הפעלתו על ידי המשתמש, בתוך "מסגרת" באתר המקשר, או כל אתר אחר לעניין זה. 
   2. מבלי לגרוע מן האמור לעיל, החברה שומרת לעצמה את הזכות לבטל את הסכמתה לעיל למתן כל קישור לאתר, בכל עת ולפי שיקול דעתה הבלעדי.
   
   

   הורדות

   1. כל הורדת נתונים ו/או קבצים מהאתר תהיה על אחריות המשתמש בלבד. החברה לא תהא אחראית לכל אובדן או נזק שייגרמו כתוצאה מהפעלה לא תקינה, וירוסים או חומר מזיק טכנולוגי אחר שעלול להיווצר בציוד המחשב, תוכנות המחשב, הנתונים או חומר קנייני אחר של המשתמש עקב השימוש באתר או הורדת כל תוכן המתפרסם בו, או בכל אתר אינטרנט המקושר אליו.
   
   

   הצהרות

   2. החברה אינה מתחייבת כי התכנים המוצגים באתר זה יהיו ללא שגיאות, או כי האתר או השרת/ים המעמידים את האתר נקיים מווירוסים או רכיבים מזיקים אחרים. החברה אינה מתחייבת לכל מצג שהוא לגבי השימוש או התוצאות של השימוש בחומרים או בתכנים באתר מבחינת נכונותם, דיוקם או מהימנותם. המשתמש אחראי לנקוט בכל אמצעי הזהירות שהוא סבור שהם הכרחיים או מומלצים כדי להגן עליו מפני כל תביעה, נזק, אובדן או סכנה שעלולים להיווצר מתוקף השימוש או הסתמכותו על האתר ותכניו.

   2. חלק מהתוכן באתר עשוי להיות מסופק על ידי צדדים שלישיים. כל דעה, עצה, הצהרה, שירות, הצעה או מידע אחר שהובע או זמין על ידי צדדים שלישיים כאלה, הם אלה של המחבר/ים או המפיץ/ים בהתאמה ואינם בהכרח מציינים או משקפים את עמדת החברה.

   כללי

   1. תנאי שימוש אלה יחולו ויפורשו בהתאם לחוקי מדינת ישראל. הצדדים יגישו את כל מחלוקותיהם הנובעות מתנאי שימוש אלה או בקשר אליהם לסמכות השיפוט הבלעדית של בתי המשפט של תל אביב.
   2. אם הוראה כלשהי בתנאי שימוש אלה תיקבע כלא תקפה או בלתי אכיפה, ההוראה תיחשב כניתנת להפרדה מיתר תנאי שימוש אלה ולא תגרום לבטלות או לחוסר אכיפה של שאר תנאי השימוש הללו. זהו ההסכם המלא והממצה בין משתמשי האתר לבין החברה בכל הנוגע לתנאי שימוש אלה לא ישונו אלא כמפורט לעיל ולהלן. הוויתור של החברה על תיקון הפרה של הוראה כלשהי מתנאי תקנון זה לא  יתפרש כוויתור על כל הפרה אחרת או הפרה מאוחרת בזמן מאותו סוג.
